Terms of Use
These Terms of Use ("Terms") govern your access to and use of the MotoLean X website, web dashboard, authentication interfaces, documentation, and any related services made available online by Bytebandits OÜ, an Estonian private limited company with registration code 17265228 and registered office at Tartu mnt 67/1-13b, Kesklinna linnaosa, Tallinn 10115, Estonia ("Bytebandits", "we", "us", "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.
Last updated: 22 March 2025. We may modify these Terms; the "Last updated" date will change and, where legally required or appropriate, we will provide additional notice. Continued use after changes become effective constitutes acceptance unless mandatory law provides otherwise.
1. Definitions
"Services" means the MotoLean X web properties, account features, rider analytics dashboard accessible through the browser (including client-side processing of files you upload), support channels we operate, and any other online functionality we expressly include within MotoLean X branding, excluding third-party sites or services merely linked from our pages.
"User" or "you" means the individual or, where an account is created on behalf of an organisation with proper authority, the organisation acting through that individual.
"User Content" means files, metadata, text, or other materials you upload, transmit, or generate through the Services, including without limitation GPX traces, session names, notes, and profile fields.
2. Eligibility
You represent that you are legally capable of entering into a binding agreement under the laws applicable to you. If you use the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity. You must comply with export control, sanctions, and anti-boycott laws; you may not use the Services if you are barred under applicable law or if we have previously terminated your account for serious breach.
3. Accounts
Certain features require an account. You may register using methods we support (such as email and password or Google Sign-In via Firebase Authentication). You agree to provide accurate information, safeguard credentials, and promptly notify us of unauthorised access. You are responsible for activity under your account except where we are at fault for a security failure on our side.
Third-party identity providers impose their own terms; your use of Google Sign-In remains subject to Google's policies. We are not responsible for outages, account lockouts, or policy changes by third-party platforms.
4. Licence to use the Services
Subject to these Terms and your compliance with them, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Services for your personal or internal business purposes related to motorcycle riding analysis and training, and not for any unlawful or prohibited purpose.
Except where open-source licences expressly govern specific components we distribute with attribution, you may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract source code of the Services, circumvent technical limitations, or use automated means to scrape or stress the Services without our prior written consent.
5. Beta features, mock data, and accuracy
MotoLean X is under active development. Certain dashboard views, datasets, or metrics may be illustrative, simulated, incomplete, or labelled as mock data during phased rollouts. Analytics outputs — including lean-angle estimates, lap times, sector splits, pace comparisons, and quality scores — depend on sensor fidelity, GPS multipath, file integrity, map matching assumptions, and algorithmic heuristics. They are provided for training and informational insight only and must not be treated as certified timing suitable for regulatory competition results, insurance disputes, or legal proof of speed or location without independent verification.
We may change, suspend, or discontinue any feature with or without notice, particularly during testing. We do not warrant specific availability percentages unless separately agreed in a paid enterprise agreement referencing explicit service levels.
6. User Content
You retain ownership of your User Content. By submitting User Content, you grant Bytebandits a worldwide, royalty-free licence to host, process, transmit, display, and create derivative analytical outputs solely to operate, improve, secure, and promote the Services, including storing copies on processors' infrastructure and creating backups, for the duration necessary to fulfil these purposes unless a longer retention is required by law or you delete the content and our systems complete deletion in ordinary course.
You warrant that you have all rights necessary to upload User Content and that doing so does not violate third-party rights, privacy, or applicable law. Do not upload content you are not entitled to share (for example traces recorded inside restricted facilities without permission). You are solely responsible for the sensitivity of locations revealed in your files.
7. Acceptable use
You agree not to:
- Use the Services in violation of traffic laws, track regulations, or event rules, or to plan or glorify illegal street racing or reckless endangerment.
- Upload malware, conduct denial-of-service attacks, probe or scan for vulnerabilities without authorisation, or attempt unauthorised access to systems or data.
- Harass, threaten, impersonate, or deceive others; distribute hate speech or unlawful content; or infringe intellectual property.
- Mine cryptocurrency, send spam, operate botnets, or resell access to the Services without agreement.
- Misrepresent affiliation with Bytebandits or MotoLean X, or use our brands in a manner that causes confusion or dilution beyond nominative fair use.
We may investigate violations and cooperate with law enforcement. Remedies include suspension, termination, and preservation of evidence.
8. Intellectual property
The Services, including software, visual design, text, logos, and compilation of data (excluding your User Content), are owned by Bytebandits or its licensors and protected by copyright, trademark, and other laws. Except for the limited licence in Section 4, no rights are granted by implication or estoppel.
If you believe material on the Services infringes your copyright, send a notice containing the information typically required by applicable law (identification of the work, infringing location, contact details, good-faith statement, accuracy declaration under penalty of perjury where required) to our contact email listed on the Impressum. We may remove or disable content in appropriate circumstances.
9. Third-party services and open data
The Services may display maps, fonts, telemetry schemas, or APIs provided by third parties. Your use of those elements may be subject to additional licences or attribution requirements. We are not responsible for third-party downtime, pricing changes, or policy updates.
10. Fees
Unless we expressly offer a paid plan with checkout terms, the Services are provided without charge for the features then designated as free. If paid offerings are introduced, they will be governed by separate checkout disclosures (price, renewal, taxes, withdrawal rights) that supplement these Terms for the transactional elements.
11. Privacy
Our Privacy Policy describes how we process personal data, and our Cookie Policy describes cookies and similar technologies on the website. By using the Services, you acknowledge that processing may occur as described there.
12. Safety, motorsport risk, and medical disclaimer
Motorcycle riding, track days, and competition involve inherent risks of serious injury or death. The Services do not replace rider skill, judgement, vehicle maintenance, protective equipment, or compliance with venue rules. You voluntarily assume all risks associated with your riding activities.
Nothing in the Services constitutes medical, physiological, or psychological advice. If you have health concerns affecting your ability to ride safely, consult qualified professionals before participating in high-intensity riding or training programmes informed by telemetry.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.
Some jurisdictions do not allow certain disclaimers; in those jurisdictions, our warranties are limited to the minimum extent required by law.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BYTEBANDITS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS (WHETHER IN CONTRACT, TORT, OR OTHERWISE) WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY EUROS (EUR 50), IF YOU HAVE NOT PAID US ANYTHING DURING THAT PERIOD.
Mandatory liability for intent, gross negligence, personal injury or death caused by negligence, or other categories that cannot be limited under applicable law (including under Estonian law as interpreted in consumer relationships) remains unaffected by the foregoing caps to the extent such limitations are void.
15. Indemnity
You will defend, indemnify, and hold harmless Bytebandits and its affiliates, officers, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your User Content, your misuse of the Services, your violation of these Terms, or your violation of third-party rights or laws, except to the extent caused by our wilful misconduct or gross negligence.
16. Suspension and termination
We may suspend or terminate access to the Services, with or without notice, if we reasonably believe you breached these Terms, pose a security risk, or must comply with law. You may stop using the Services at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations, indemnity, governing law, and dispute resolution) will survive termination.
17. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Estonia, excluding conflict-of-law rules that would refer to another jurisdiction, and without prejudice to mandatory consumer protections of the country where you habitually reside in the EU or UK that cannot be contractually waived.
Subject to mandatory provisions on jurisdiction, the courts of Tallinn, Estonia, shall have exclusive jurisdiction over disputes arising from these Terms between Bytebandits and business users or users outside mandatory consumer jurisdiction rules. Consumers may also bring proceedings in the courts of their place of residence where EU or national law so provides.
18. Miscellaneous
If a provision is invalid or unenforceable, the remaining provisions remain in full force and effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, Cookie Policy, and any feature-specific terms presented at the point of use, constitute the entire agreement regarding the subject matter. Nothing creates an agency, partnership, or joint venture. Communications may be electronic and satisfy legal writing requirements where permitted.
